more than half the car value is owing.

I'll have to have a chat to the finance company, find out the exact amount owing, go to the bank to get a bank cheque for that amount made out to them.

If you pay them the whole amount they will refund him the difference. That us what I have always done

Hi.
If you get a bank cheque made out to the finance company do not give it to the seller. Contact the finance company in person and you get the cheque to them and have them confirm the amount owing and in writing the car is free of any encumberance after payment. I am at a loss as to why he would bring the mortgage into the picture and make a statement that after sale he would payout the loan.His business skills seem at odds with his profession.This loan may be linked or part of his house mortgage. Tread warily as sometimes things are not all they seem.

He seems like a decent guy, but I could get stuck with a car with money owing, if he doesn't pay it?

Doctor or not, this is just so much BS. Don't do anything until the car's title is clear. People always seem nice until they rip you off. If the REVS check is showing the car is encumbered, then it is encumbered. My advice - do not go ahead with the transaction until it is showing as unencumbered i.e. he has paid out the loan and the REVS check is clear.

I speak from experience after getting ripped off by the nicest possible person before REVS or anything like it existed (1970) and there was no way to check, even though I had a friend check through registration records. It took about 6 months, but eventually the finance company came knocking to seize the car - just after he fled the country. :evil:

He's not being deceptive with that comment as it stands, but linking it to what he's suggesting, ie you pay him in full, & he subsequently pays out the loan on the car, may be, unless that's his mistaken understanding, which as a doctor (his assertion) is a little worrying. If possible, contact Medfin & explain that you wish to buy the car of one of their clients who is trying to sell & seek their advice, but my understanding like others above is that Medfin will need to be paid out in full first either by you or him. If it's you that pays Medfin, then obviously he'll need to agree to that arrangement. Good luck!

So it all went well!!!!!!
We went to the bank, did a direct transfer to the finance company and she took off the encumbrance over the phone.

It's such a beautiful car I'm so excited!!!!!!
